TO: ALL CONSTITUENTS OF THE COMPLIANCE COMMISSION
(Lawyers, Accountants, Real Estate Brokers, Land Developers, Dealers in Precious Metals and Stones, Pawn Shops, and Persons Acting in the Capacity of Trustee)

SUBJECT: Registration with the Compliance Commission of The Bahamas

The Financial Transactions Reporting Act 2018 (“FTRA”) was enacted on 25th May, 2018. The Compliance Commission (“the Commission”) is the Supervisory Authority for all Designated Non-Financial Businesses and Professions (“DNFBPs”) in section 4 of FTRA when the above-mentioned businesses and professions provide services specified in paragraphs (a), (b), (c), (e), (f), and (g)(iv) of section 4 of the FTRA. Pursuant to section 33(1) of the FTRA, all DNFBPs must register with the Commission. Failure to register will result in the application of the Commission’s Administrative Penalty Regime. According to the Administrative Penalty Regime, an individual is liable to a penalty of up to fifty thousand dollars ($50,000.00), whereas a financial institution is liable to a penalty of up to two hundred thousand dollars ($200,000.00) for failure to register with the Commission.
